Standard Terms of Business

Thank you for visiting the website of David Fathers. Please read carefully the terms of business which follow, they are for your, as well as our, protection and please note that by placing an order with David Fathers via the website, you are consenting to be bound by these standard terms of business.

Expectations on timings, e.g. fulfilment/delivery

Subject to product and stock availability, we expect to dispatch your order, for delivery within the UK only, within five (5) working days of receiving order(s).

Payment Policy

Payment details for all orders are required at the time of order placement.
Shipping outside the UK is charged at different rates – please contact us for details.
Processing of payment will be made when you place your order.

Returns, Refunds and Complaints policy

We try our hardest to provide the very best service and the very best product. We are always concerned that clients are happy with the product supplied and will do everything in our power to remedy situations where they are not. Complaints regarding the goods supplied must be made within seven (7) days of delivery of the order (by contacting us at the e-mail/telephone numbers shown below) or they cannot be considered.

All faulty/damaged goods must be returned to us (address below) before we send out replacements.

If for any reason you are dissatisfied with a product from our stock range (excluding bespoke and personalised items) purchased through the website, we will offer you a full refund or replacement with a comparable and similarly priced product provided the goods are returned to us within seven (7) days of receipts of the goods.

If we have made an error in fulfilling your order, we will correct or replace promptly the items supplied to you.
Where your purchase has been made using a credit card and you have chosen to receive a refund, the refund will be made to the same credit card within fourteen (14) days of notification.

Loss and damage (in transit)/faulty goods

David Fathers offers a choice of replacement or a full refund for goods that have been damaged in transit or are faulty. Please contact us (see details below) to notify us of the problem. Then please return the damaged or faulty goods, together with the packaging within seven (7) days of receipt of the goods and we will then replace the goods or issue a refund, in line with our Refunds Policy (see above). Apply by email for the postal address.

Events beyond our control (force majeur)

David Fathers will not be responsible for any delay or failure to comply with our obligations if the delay or failure arises from any cause that is beyond our reasonable control. This condition does not affect your statutory rights.

Price changes

Prices shown on the websites are correct at the time of publication and are shown in GBP (£). We reserve the right to change prices without notice.

Product availability

The unsigned editions of the poster(s) may be withdrawn from sale without notification.

Colours and dimension tolerances

The dimensions of poster(s) shown on the websites are approximate only. How colours appear on your screen depends on how your monitor is calibrated.  In addition our scanning and production processes can result in slight variations in colour in the merchandise compared to those shown on the websites. If you have any queries regarding the size and/or colours of the poster(s) please contact us (on the e-mail or telephone number shown below) prior to ordering.

David Fathers does not sell, trade, rent or pass on your information to other parties. We are committed to protecting your privacy and the information you have provided in accordance with the law and our privacy rules and will only use the information you have provided to process your order and to provide an effective and efficient service.

We may use the information we collect to inform you about important changes to our websites and new products and services which we consider might be of interest to you. We may send you occasional e-mails, to propose offers and within these e-mails will be an opportunity for you to unsubscribe.

We follow strict security procedures in the storage and disclosure of information you have given us.

The ownership of all artwork and designs including fonts, colours, patterns and formats are retained by David Fathers. Any copying, reproduction or other use without prior, written permission is strictly forbidden but may be granted, however, upon payment of an additional fee (details available upon request).

The content of our website is directed solely at those who access them from within the UK. We make no representation that any service or product referred to in the websites is available or otherwise suitable for use outside the UK.

We reserve the right to change, modify, substitute or remove without notice any information on the website from time to time.

Access to the website may be suspended, restricted or terminated at any time.

The copyright of all material on the website resides with David Fathers, together with the website design text and graphics and their selection and arrangement, and all software compilations, underlying source code and software (including applets). All rights are reserved. None of this material may be reproduced without our prior written permission.
 
Law & Jurisdiction

The website of David Fathers (joemoon.co.uk)  - all it's content, any other activity that takes place or relates to this website and any contract that arises as a result of using this website is governed by the laws of England and Wales. By using our website you agree, as do we, to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts that may result from the usage of our website are concluded in English.
 
Liability

This section applies only to the extent permitted by law. For the avoidance of doubt, David Fathers do not exclude or limit any liability for personal injury where such injury results from the negligence of David Fathers, its employees, agents or sub-contractors or wilful default or fraudulent misrepresentation. David Fathers does not accept any liability whatsoever for any errors or omissions and reserves the right to change information, prices, specifications and descriptions of listed goods, products and services. If an error is discovered in the price of goods you have ordered, we will inform you as soon as possible and give you the option to continue with the order at the correct price, order an alternative item or accept a full refund in line with our refund policy (see above). David Fathers shall be under no obligation to fulfil an order for a product that was advertised at an incorrect price.
